Terms and conditions

    1. As part of its #FinishWaterWaste campaign (Campaign), Finish is proud to partner with Rural Aid Australia to help facilitate donations of water to those in rural Australian communities and areas of need (Water Donations).
    2. Water Donations will be made in connection with Social Media Pledges and In-Store Pledges as set out in these terms and conditions.
    3. As part of the Campaign, Finish will donate a combined total of 10,000,000 litres of Water Donations in connection with Social Media Pledges and In-Store Pledges (defined below).
    4. Recipients of Water Donations will be selected by Rural Aid in consultation with the Promoter.
    5. Finish may increase the total amount of Water Donations to match the pledges (to the extent it exceeds Finish’s estimated amounts), including the number of Social Media Pledges and In-Store Pledges, at any time at Finish’s sole discretion.
    6. Participants are individuals who participate in this Campaign by making Social Media Pledges and/or In-Store Pledges as applicable.
    7. The Promoter is RB (Hygiene Home) Australia Pty Ltd (ABN 58 629 549 506) of Level 47, 680 George St, Sydney NSW 2000, Australia.

Social Media Pledges

    1. Social Media Pledges, also referred to as Promises, are original social media posts made by Participants in Australia on Facebook, Twitter or Instagram (each a Platform, as applicable) that contain the hashtag #FinishWaterWaste between 5 July 2020 and 1 August 2021 (Social Media Campaign Period) and comply with these terms and conditions. Social Media Pledges also include original social media posts relating to participation in the Campaign via the 40L challenge.
    2. For each of the Social Media Pledges made during the Social Media Campaign Period, up to 50,000 Social Media Pledges, the Promoter will make a $1 donation, which is equivalent to a 40L Water Donation, to Rural Aid up to a total of 2,000,000 litres.
    3. Participants acknowledge that use of the Platform is subject to the terms and conditions of that Platform. Participants must make their Platform profiles “Public” and set the Social Media Pledge post to be visible by everyone.
    4. The thoughts and views expressed on each of the Platforms are only the thoughts and views of the individual that posted them. They are not representative of the opinions of the Promoter, nor does the Promoter confirm, guarantee or warrant the accuracy, completeness or usefulness of any Social Media Pledge. This Campaign is in no way sponsored, endorsed or administered by or associated with any Platform. It is a condition of participating in this Campaign that each Participant grants a complete release to the Platforms from any claims that they now have or may have in the future which relate to or are incidental to this Campaign.
    5. Social Media Pledges must be original and must not infringe the intellectual property rights of any third party.
    6. Participants agree that the Promoter has an unrestricted, royalty free, irrevocable, transferable right to use and modify their Social Media Pledge (including, but not limited to, amending, editing, selecting, cropping, retouching, adding to or deleting from any part of the Social Media Pledge) for the purposes of the Promoter’s business, including for marketing or promotional purposes, without the payment of any further fee, compensation or any further reference to the Participant. To the extent permitted by law, Participants unconditionally and irrevocably consent to any act or omission that would otherwise infringe any moral rights in their Social Media Pledge. Participants accept all risks necessarily flowing from their participation in the Campaign including the 40L challenge. Participants agree that the Promoter is not liable for any loss or damage suffered by the Participants or others arising from their involvement with the Campaign including the 40L challenge. Participants agree to indemnify the Promoter, its related bodies corporate, agencies and contractors against all losses, damages, claims and costs by third parties arising out of, connected to or resulting from a breach of the warranty set out in this condition.
    7. Details from Social Media Pledges, which may include personal information of the Participant may be used for the purposes of conducting this Campaign (which may include disclosure to third parties, the Promoter’s related bodies corporate, agencies and contractors for the purpose of conducting the Campaign) and for marketing or promotional purposes and advertisements surrounding this Campaign.
    8. By making a Social Media Pledge, Participants consent to the use of their information as described in these terms and conditions, including in any media for future marketing or promotional purposes without further reference or payment to the Participant.

In-Store Pledges

    1. In-Store Pledges are purchases of the following products made between 2 September 2020 and 27 October 2020 (Coles In-Store Campaign Period) at Coles supermarkets in Australia, including Coles Online (Participating Coles Stores), and excluding Coles Express:
      1. Finish Quantum Ultimate Pro Original 16 Tablets 
      2. Finish Quantum Ultimate Pro Lemon Sparkle 16 Tablets 
      3. Finish Quantum Ultimate Pro Baking Soda 16 Tablets 
      4. Finish Quantum Ultimate Pro Original 32 Tablets 
      5. Finish Quantum Ultimate Pro Lemon Sparkle 32 Tablets 
      6. Finish Quantum Ultimate Pro Baking Soda 32 Tablets 
      7. Finish Quantum Ultimate Pro Lemon Sparkle 48 Tablets
    2. For each of the first 200,000 In-Store Pledges made during the Coles In-Store Campaign Period, the Promoter will make a $1 donation, which is equivalent to a 40L Water Donation, to Rural Aid up to a total of 8,000,000 litres.
    3. The In-Store Pledges are exclusive to Participating Coles Stores.

General

  1. This Campaign is not a trade promotion and there is no prize or gifts to be won. For the avoidance of doubt, this includes upon participation in the Campaign via the 40L challenge. Water Donations are not transferrable and are not redeemable for cash. The Promoter’s decision is final and binding – no correspondence will be entered into. Water Donations must not be resold or offered for resale or used for advertising, promotion or other commercial purposes by the Recipient of Water Donations without the express consent of the Promoter.
  2. The Promoter accepts no responsibility for late, lost or misdirected communications. To the extent permitted by law and without limiting any rights under any applicable law, including the Competition and Consumer Act 2010 (Cth), the Promoter assumes no responsibility for any failure to receive an information or for inaccurate information or for any loss, damage or injury suffered as a result of receiving the Water Donations or making Social Media Pledges or In-Store Pledges.
  3. If circumstances beyond the control of the Promoter or Rural Aid prevent the Water Donations from being fulfilled, the Promoter may provide a cash donation of equal or greater value to Rural Aid or the intended Recipient.
  4. The Promoter may in its discretion modify, cancel or suspend the Campaign at any time, including but not limited to, increasing the maximum amount of total Water Donations.
  5. These terms and conditions are governed by the laws of New South Wales.
